Wallrace Legal

These Terms of Use are the End User License Agreement (“EULA”) between you and Vexellab Solutions LLP (“Vexellab”, “we”, “us”) for the Wallrace mobile game (“Wallrace”).
This EULA is concluded between you and Vexellab Solutions LLP only, and not with Apple Inc. or Google LLC. Vexellab, not Apple or Google, is solely responsible for Wallrace and its content.
By installing, accessing or playing Wallrace, you agree to this EULA. If you do not agree, do not use Wallrace.
Vexellab grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to install and use Wallrace for your personal, non-commercial use, on devices that you own or control, in accordance with the usage rules of the store from which you obtained the app (the Apple App Store or Google Play).
This license does not transfer ownership. Vexellab and its licensors retain all rights in Wallrace, including its name, artwork, sounds and code. You may not sell, rent, lease, redistribute, sublicense or transfer Wallrace, and you may not copy, modify, reverse engineer, decompile or disassemble it except where that restriction is prohibited by law.
Wallrace is a turn-based race game for one to four players on a single device. Each turn a player either steps their ball or places a wall; every wall blocks every ball. You can play against other people passing the device, against computer opponents, or online in rooms shared by code. An account is only needed for online play. Wallrace has no purchases or ads.
Wallrace is provided free of charge. If paid features are ever offered, their price and terms will be shown in the app and processed by the app store before purchase.
We may update, change or discontinue Wallrace or any of its features, modes or rules at any time, including to keep the game balanced or working on new devices.
Wallrace is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including fitness for a particular purpose and non-infringement. We do not guarantee that Wallrace will be uninterrupted or error-free.
To the fullest extent permitted by law, Vexellab will not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of data or enjoyment, arising from your use of or inability to use Wallrace.
This license is effective until terminated. It ends automatically if you fail to comply with this EULA. On termination you must stop using Wallrace and delete it from your devices.
Vexellab is solely responsible for support and maintenance of Wallrace. Apple and Google have no obligation to provide any maintenance or support services for Wallrace. Contact Vexellab through the main website contact page.
In the event of any failure of Wallrace to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price of the app to you, if any. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to Wallrace.
Vexellab, not Apple or Google, is responsible for addressing any claims relating to Wallrace, including product liability claims, claims that Wallrace fails to conform to any legal or regulatory requirement, consumer protection claims, and third-party intellectual property claims.
You represent that you are not located in a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
Apple Inc. and its subsidiaries are third-party beneficiaries of this EULA and, upon your acceptance of it, have the right to enforce it against you as a third-party beneficiary.
This EULA is governed by the laws of India, without regard to conflict-of-law rules, and the courts of Kerala, India have jurisdiction, except where mandatory consumer protection laws of your country of residence provide otherwise.
We may update this EULA from time to time. The date at the top shows the latest version. Continued use of Wallrace after an update means you accept the revised EULA.
